If they repossessed someone car and then there is some amount owed, is this legal for them to garnish someones wages who is on SSI and does not work , and who lives in California

  1. SSI disability benefits are exempt from garnishment to satisfy consumer debt.

    However, the auto finance company would have to take you to court first to get a civil judgment against you.

    Although your SSI benefits are exempt, if you have money in the bank or own any other assets, those assets can be seized if they are not otherwise exempt by Californa law.

  4. SSI is not subject to garnishment. If you don’t work, you don’t HAVE wages. SSI is NOT wages. Your state does not matter. Federal law exempts SSI from garnishment.
