This dude owes me 200 bucks and he is refusing to pay up so i’ve resolved to sneak into his garage and hide his car till he pays up.

  1. No what you’re talking about is breaking and entering and grand theft. LOOONG jail term. Really horrifically bad idea.

    "Repossess" means you sold him the car and he’s not making payments. THere are clear legal steps you must follow to repo a car. What you’re talking about is theft.

  2. Think about the words you are using.

    You cannot REpossess something you never had (legal) possession of.

    For a company/person to be able to legally REPO a car, they must hold a lien on it – a contract that says they have the right to take back possession of the car if the terms of the loan are not met by the buyer.

    Taking the car simply because he owes you $200 would make you a thief and subject to felony charges.

  4. You can only take his car if you hold a lien on it, a contract that says he gave you the right to take his car if he didn’t repay you. The contract needs to state how the debt was to be repaid, when it was to be paid, and proof that he broke your contract. A bank has a lien on a financed car but can’t repossess it unless a payment is missed. If all he said was I’ll pay you back when I can that’s not a contract because all he needs to say is I can’t pay.

    Without both a lien and a broken contract it’s car theft.

    No, repossessing the dude’s car is not an option, unless you financed the car and he’s missed his monthly payment. I get the impression that’s not the case here.

    If you did that, you could be charged with auto theft, which would probably be a felony, given the value of cars these days.

    Find another way. Something without committing a crime or violent act.

  6. That’s called car theft and I don’t think jail is worth 200 bucks. His owing you money doesn’t allow you to take his car even if it for a short period of time.

  7. you need to get a court order, that is done in small claims court. Once you have the order for the guy to pay up then you have the sheriff take his car if he doesn’t.

    Don’t take the law into your own hands, you will end up in a world of hurt.
