can you please read these rules for action….are they fair?

Light System Rules:
REGARDLESS OF THE COLOR OF THE LIGHT ALL VEHICLES PURCHASED OR SOLD FOR 00.00 OR LESS ARE SOLD "AS-IS"!
• Red Light – ("AS IS") Sold with no arbitration. Unit is sold subject to any and all defects.
• Blue Light – ("Title Attached") Assignable title does not accompany car. Seller has up to 40 days to produce title. Buyer is cautioned not to spend any money on unit and not to sell unit until the title is received. After the 40-day period, it is the buyer’s option to return the car, or to wait a reasonable additional period of time for the title. When a buyer returns a vehicle because a title has not been timely delivered by the seller for any reason; the seller is responsible for all auction fees due on the transaction. The buyer will be responsible for the expense of returning the vehicle to MID-STATE AUTO AUCTION.
• Green Light – ("With Drive") Buyer has the right to up-to-one hour test drive the vehicle prior to finalizing sale. Vehicle is subject to arbitration policies.
Arbitration Policy
The following are subject to arbitration unless announced or identified on the block:
• Frame damage or frame repairs if reported to the auction within 48 hours of purchase. [Green Light Vehicles ONLY]
• Engine/Drive train/Defective AC systems if reported prior to leaving the premises.
• In spite of anything that may be stated otherwise in these rules and policies, cars selling for 00.00 or less and all diesels are sold "AS IS" and are not subject to arbitration.

How would I know about an AC problem that kept cutting in and out, or only blew cold air intermittently?

"• Engine/Drive train/Defective AC systems if reported prior to leaving the premises." seems unfair. How would I know about an AC problem that kept cutting in and out, or only blew cold air intermittently? Now, if this is after the "1 hour test drive", then it looks kosher.
