Car has been repossessed with some stuff in it?
8th April 2011
When my car was repossessed because the payment was mailed back for a lack of 3 cents on the postage so it was late by a day or two the guy repossessing it was about to take it away when my mom went out to talk to him. Then i asked if we had to take everything out of the car and he said we didn’t have to but we could so i decided to just in case. But he though we got everything out so just drove away with my car in tow. But there was still a 3-4 hundred dollar pair of glasses my dad bought awhile back and a bunch of cds in the cd player. Now Honda decided to sell the car only after a day or two after repossession. How can i get the stuff back. Is he legally supposed to mail everything back to us or is he allowed to sell it off?

You are entitled to the contents but they thought you got everything out.
You are also supposed to get so many days after repo before they sell it.
I know one large finance company would retain the personal items from each car for 30 days and then give them to goodwill if they were not claimed.
I promise you your car didnt get repoed just because you were a day or two late and 3 cents short.

Regardless of the method used to dispose of a repossessed car, a creditor may not keep or sell any personal property found inside. In some states, your creditor must tell you what personal items were found in your car and how you can retrieve them. Your creditor also may be required to use reasonable care to prevent anyone else from removing your property from the car. If your creditor can’t account for articles left in your vehicle, you may want to speak to an attorney about your right to compensation.
Despite these facts in actual reality it’s bad news I’m afraid…..the cd’s, sunglasses and any other content will be removed from the car. You should always remove any belongings from a car before selling it or before it gets repossessed.

You are SOL.
Legally they are still yours, you have to go and collect them but the challenge will be to prove the items were in the car when it was repo-d, as the truck driver probably stopped on his way to the impound lot to have a dig though the car to see what he could find.
Sorry

we have two sons who are repo drivers, and both said that all of the cars that they tow are immediately stripped to the bare bones when it gets to the shop, regardless of ownership or content, then washed and sent to auction, what ever was in there was trashed and sent to the land fill morning after. kiss it good bye, sol

It`s still legally yours, but you will have to trace it and fetch it back. They are under no obligation.
