My Moms car was repossessed and during this time, no one was at home. During this time, my mom’s neighbor told her that when the tow truck company came out, they had broken the steering column to get the car. Now the bill has been paid and not the creditor nor the tow truck company is fessing up to it. The tow truck company says it was like that prior to them picking up the car and said it makes no sense that their people would break the steering column. Why would they do that? She can’t afford to get that fixed and towed from where it is at. What steps should we take now?

  1. I would call a lawyer for a free consulation and see what they tell you to do.

  2. You have witnesses, and towing company is responsible for the damage. Try first to get to the owners of the towing company with written statement from your neighbors and with story that U can sue them for damages. They will not gamble and go on court because of small thing, knowing that they are wrong and pay for the damage and legal fees, they are going probably to accept if you ask only for repair.

  3. They’re right.

Absolutely no reason to break a steering column. Doesn’t help with a thing.

Could easily be someone damaged it while it was stored at their lot. Which they are not responsible for.

Steps you should take: Hire the CSI cast, and prove that they were the ones that damaged it.

If unable to, then you have no case. Innocent until proven guilty, beyond a reasonable doubt.

And you’re unable to do that. Sorry, that’s really just the way it is, though.

You have a witness, yes, but that’s hearsay. They say one thing, company says another. So both are thrown out the window, until guilt is proven.

People don’t win lawsuits with only one witness account.

  4. Your mom should pay her bills and things like this won’t happen.
