I am a first time car buyer. I bought an used truck and found out after signing the contracts, that the dealer put the wrong mileage on the contracts. I have proof that the mileage is wrong, and I am wondering if it is legal for the dealer to put inaccurate mileage on contracts. If not, what should I do about this?
The mileage on the contract I signed was wrong, and because of this, I couldn’t take advantage of the John Elway three day guarantee. I made the mistake of trusting the car dealer, and now I am stuck with a truck I don’t want. I have proof that the mileage on the contract was wrong, but I already signed the contract. Is it legal for the car dealer to print inaccurate information on a contract, and is there anything I can do about it?

  1. Why did the mileage stop you from taking it back within the 3 day guarantee???? I think you just have buyer’s remorse and want to get out of buying the vehicle so thinking up excuses. Won’t work…. you signed the contract, it’s yours.

  2. You probably cant do anything about it if you have signed it..That is what the signature is for..It states that the mileage is correct and you agree to it..

    Really sounds like to me that you are searching for a way out of a signed contract..

    Never sign without reading!

    If it was printed on the contract and you signed it stating that it was acurate,then it is acurate..You said it was by signing!
    Sorry this is not what you wanted to hear but that is what contracts are made for..

    I am sure that if it is a recent problem and it was a mistake,they will be glad to rectify it..
    No way for it to benefit them unless it would mean a difference in a warranty or something..

    First, go back to see what they have to say about it.

    Is it affecting any warranty you got? What is the problem with the mileage, other than it is not correct?

  4. Nope it’s not legal…..are you curious as to why he would do that? Whats the big deal unless its a HUGE diffrence? If it is bothering you that much, then go to the dealership with your vehicle and your proof and ask him to fix it. If he won’t then ask for the Boss Man.
    FYI: Even if you did sign, you can get out because they broke the contract by lying to you. You will need proof. However if the diffrence is small you may not win.

  5. It depends on how wrong. If they merely rounded off to the nearest 100 miles or 1000 miles, then it is perfectly legal. If they accidentally put the wrong information , then it is just an error. If they INTENTIONALLY FAULSIFY INFORMATION ON A LEGAL DOCUMENT, then it is a serious crime. I woudl call the dealer about the assumed error and ask them about it. If it is an oversight, they should be more than willing to correct the error. If they are not willing to correct the error, then contact the local police and look into filing charges of faulsifing legal documents.

  6. It is absolutely illegal to list the incorrect mileage. However, since you signed the odometer statement you essentially agreed that the mileage listed was the actual mileage on the car.
