Is it worth suing the used car deal?
10th February 2011
I am in the middle of purchasing a used car from an auto auction house. i have kept all of my documentation. I have a recent charge off on my credit from a recent car accident and know my score is not the best. I reviewed docs that were sent to me from the finance company which do not match the forms i signed. I put a down pmt of 00 on my visa and later sent 0 over the phone 9days later. Less than two days after I drove off the lot (not yet financed) the car made horrible noises and with the sellers permission i took the car to the nearest manufacturer’s dealer, the repair was minor. The seller "took care" of the repairs, rental and diagnostic charges. On the agreement i signed the sales price is ,300 plus GAP, warranty and standard fees. The pink I just received in the mail from the finance company shows an inflated sales price of around ,150 with no GAP or warranty, it shows my total down payment of 00 on the original purch date & forged signatures. I need a car, this one works great, and want to start trying to fix my credit should i just play along?

I say suing them would be a right thing.

You have a good case. Sue them.
Good Luck…

i wish i could help but unclear on exact amounts and why would you want to sue the dealer if the finance company has it wrong and what is GAP ? and wouldn’t your interest show on the statement from the finance company? If you really feel its wrong call them and take notes who you talk to the date and time and keep calling until you get someone to explain it.

I’d say the dealer is in the Clear. He helped you out with the repair. Took care of Rental as well. So I’d not sue the Dealer.
The Finance Company is a different matter. You might want to first read all the paper work before hand. You might want to talk to them and explain the discrepancies. Take notes of who you talk to and their side. It could probably be due to your low credit. Point is they might have a valid explanation.
In the mean time talk to the Dealer any way. Ask him what if you brought your own finance from your bank ? If he can reverse the paperwork, That’s the best way.
Of course if he can’t & the explanation from the Finance company is not satisfactory, go ahead & seek legal advice.
