My tenant is in constant financial trouble and today is no exception. He is getting calls from "someone" saying he owes child support and they are threatening repossession. He literally only owns one thing: his 0, 1980′s car.

He has asked my husband to buy his car from him for a dollar so that it cannot be repossessed, but then he would still have it for use.

Is this even a possibility? What are the possible repercussions for us? Also, like I said, that car is literally the only thing he owns. All of his furnishings, everything in his apartment belongs to my husband and me and we allow him its use. Is there a chance they will try to repossess any of this stuff?

Also, is there anyone he can talk to about his finances? He is having constant problems with his child support, he owes ,000 in backtaxes, he owes money everywhere, and he is still technically married to his ex, who constantly runs up bills in his name. He cannot even open a bank account because every bank he goes to tells him he owes money to this clothing store or that jewelry store? Who do you talk to when your finances are so bad, you can’t even afford to talk to someone about them?!

  1. He is trying to avoid his debts by hiding his assets. This is illegal. If you help him do it, you might be accused of being an accessory, although it is unlikely. They could easily show that selling the car for a dollar was a sham, and repossess the car anyway.

    However, it is rare to have your car repossessed for child support. The laws are different in every state, but I doubt they can repossess his car.

    He needs to talk to a lawyer about his ex running up bills in his name. He may have to bring criminal charges against her and/or put a credit block on his name.

  2. Your tenant got himself into this situation. If you buy the car for $1, you have to add your car insurance because it no longer belongs to him.If he has an accident, it’s your problem, not his. All he has to do is walk away. It’s time you got a new tenant. Never do any favors for friends or family members because they will never pay it back.

  3. I wouldn’t do this at all. First of all, it really muddies the waters of your landlord tenant relationship. If bad things happen in the future, and you need to evict him, you might have a tougher time. This is also taking on a huge liability. If he wrecks this car and injures someone else, you could be sued for damages above what you are insured for. this puts your properties and wealth at risk. Finally, hiding assets to avoid seizure is illegal. You’d be an accessory to this. I would just say no.

  4. None of the story makes any since. 1st NO one can repossess his car if it’s payed for. Never and I mean Never let someone drive a car that’s in your name, if they get in a wreck and kill or cause damage to someone then you are the person they will sue, that would be a very big mistake to make and I sure he has no insurance, call your insurance agent and ask them if it would be a good idea to put the car in your name and ask them what would happen if he wrecks the car and damages someones car or person, "you" could lose everything. 3rd just because you owe money to someone does not mean they can repossess anything. The reason he is having problems with his child support is because he is not paying it. No sure how his technically wife is running up bills in his name when he has no credit. The bank does not care if he owes money to a clothing store or jewelry store, that has nothing to do with opening a bank account. He owes money to a bank for most likely bad checks, that’s why he can’t get a bank account. It sounds like he blames everyone for his problems and takes no responsibility for his self.
