Now my car no longer runs and I need to junk it but the title still has a lien on it.  What can I do to get rid of my car?  I am not looking for a profit, just want to get rid of it.<br />
I should also note that I do not have the money to pay them off.</p>

<p>The finance co contacted the guarantor by phone 2 weeks before and said that they would call back as they were informed that the car was paid for 1 year ago, in full end of 2009.  They did not call just picked up the phone from my address.  I thought it was stolen as I had no prior warning or a note from them,   They cannot find the payments and I have sent them proof from my bank for the 6 requested.  this has had a massive impact on my life as I drive to work etc.</p>
<p>The finance co did not update their records of change of address for guarantor in 2007 so he did not receive any warning letters and he has not changed his phone number.  They called in the past when the could not find payments which was resolved by them checking their records for some time.  My circumstances have not changed and set up a direct debit for 5 years without any breaks.<br />
For all that read the details properly, the car was paid for in full 1 year ago and I have the bank statements to prove, the finance company cannot find the payments as they merged with another co in 2007 and they have made previous calls to say that they cannot find payments which they later found.  I was not informed personally of them removing it by letter because they did not update their records previously with the guarantors new address.  But have always had the same telephone number.  We called the finance co because of a previous call they made to the guarnator saying that they was going to remove the care of which they were told that the car has been paid for.  And I did report it to the police first and they could not trace ithe car in the whole country for 3 days thats why we called the FC.  I also faxed my evidence to the FC 4 times and posted before they finally gave me a call, to say that they received it 2 weeks ago no one updated the history at no time.</p>

As part of the chapter 7, we were planning on reaffirming our mortgage and 1 vehicle loan.  Currently we are about 4 months behind on the auto loan.  Today, the vehicle was repossessed.  It is coming back tomorrow as the finance company went against the rules by not releasing it on the docket or notifying us of the repossession.  Our issue is, we are now thinking of including the vehicle in the bankruptcy after all since we are already under water with it, and we have not yet signed a reaffirm notice.  My question is, can we get a car loan during an open chapter 7, how should we go about doing so, and is there anything we need to do?  I don&#8217;t want to jeopardize the bankruptcy while it is open.  Help!!!</p>

I disputed all 3 judgments and they were all removed. QUESTIONS: if they notice, can they put it back on? What are the chances of them noticing? MOST IMPORTANTLY!!!!!!!!!! , if i never pay, can they garnish my wages or take my tax refund? Please don&#8217;t GUESS. please really know what you are talking about! Typically with repossession judgments, how far can they go to get the money?<br />
NOT THAT I SHOULD BE EXPLAINING THIS TO ANY OF YOU BUT I LOST MY JOB AND MY PAYMENTS FOR ALMOST 0 ON A FORD FOCUS BC IT WAS THE FIRST TIME I EVER FINANCED A VEHICLE AND SO I HAD A HIGH INTEREST RATE. SO THAT&#8217;S WHY IT WAS REPOED. I COULD AFFORD THE PAYMENT AT THE TIME I SIGNED THE DOTTED LINE.<br />

I know i&#8217;m responsible for the difference. I want to know about the tax refund and the garnishment of the wages. I understand the logistics behind everything. i know that this is protocol for them. I understand all that. none of that matters to me. i just want to make sure my tax refund and my wages are protected from this foolishness.<br />

i know that there are 3 credit reporting agencies. that was a typo. if you notice after that, i said i said i disputed all 3 judgments!<br />
equifax, experian and transunion, yes, i know this. this is one of the 1st things you learn about credit.<br />
src50, they already placed a judgment , didn&#8217;t you read what i typed? we are past that. how long after the judgment will they garnish my wages bc its been over a year.<br />

ALL YOU HAVE TO DO IS DISPUTE and the credit agencies will send out a letter asking the company to verify the account if they don&#8217;t respond in 30 days , legally it has to be removed.<br />

I lost my job in May and fell behind on my auto loan payments and definately dont have the money for repair or to pay off towing fees. I spoke to the finance company and they said there is nothing they can do to help me get my payments caught up since I have used all those options in the last 12 months. I told the finance company where the vehicle was if they wanted it since im not going to run into a financial miracle to pay all this money. It has been over a month and they have not picked the car up from repair shop. The repair shop is saying if someone does not come for the car within 30 days they will get a magistrates title and auction it. I dont even know if thats legal and I am just stressed to the limit. Does anyone know if it is legal, or have any advice? I hope this makes sense!<br />
I owe for storage and tow fees only, I told them not to repair since I did not know if I could come up with the repair amount. I knew they could put mechanics lien on it if they did.<br />
The total amount owed to finance company is 8k im behind 3 months which is 1500. The tow service was 50 to tow and 35 dollars a day it has been there since June 23rd..The cars value is a measly 3k as well../sigh</p>

			<content:encoded><![CDATA[<p>My car was repossessed on 1/29, i was 3 months behind. on 1/31 i called my finance company wells fargo and asked how much i needed to pay them to get the car back, they tell me that i need to pay the full balance of 14500. so i bite the bullet and chalk it up as a learning experience. then yesterday 2/7 i get a certified letter in the mail stating their intent to sell my car at auction, their starting price (6500.00) and where it will be auctioned. on the 2nd page it states to receive my property back i must pay the past due amount (1100.00) + 2 months security payments (730.00) and recovery costs in the next 15 days. and my loan will continue as if i never had defaulted. so i get my hopes up because i have the money now to get my car back now that im no longer unemployed and i call wells fargo up again. they tell me that that letter was a mistake and that i need to pay the full amount again. my question is would this be something i should talk to a lawyer about.  i would like to not have this repo on my credit and i can afford to make the payments or even sell the car private for more than they would get at auction.<br />
why send me a letter saying i can pay 2000 dollars and get it back then tell me i cant that same day. thats my main question.</p>
