This concerns my husband’s old Santa Fe. Here are all the details I know: he leased the car with his ex (at the time), but when they couldn’t make payments (because of her over excessive spending) they returned the car. Fast forward 7 years later, my husband learned that he is being taken to (Small Claims) court for about ,000 – the dealership is claiming he still owes them for payment of the Santa Fe.

Now, my question(s) is/are:
1. Can they do this? Even though they got the car back and it was 7 years ago?
2. He was married back then to someone else, so can they go after HER, too?
3. This was 7 years ago and my husband has since sold a house – if they had filed back then, they could have put a "lean" on the house (as he told me) to get their money back…So would this recent complaint still be valid NOW?
4. They are taking him to Small Claims Court, which (as my husband’s father said) will only get them an amount NOT EXCEEDING ,000…yet they are suing for ,000…How does this make sense?
5. Doesn’t the repossession cancel out the lease agreement because they got their vehicle back? And is it like with cell phone companies, where you can just pay a fee to cancel a contract early?
6. We aren’t married yet, but we live together and have a 3-yr-old boy…Can they garnish MY wages too?

Can anyone advise? We live in Ontario, and I’m not sure who the dealership is. All I know is that they are a used car dealership…

my total loan amount is 000 after selling the car probably they’ll put 000 on my credit and i’ve 000 in credit card. due to unemployed from last 2 years i’ve no choice but to file bk. will they go for wage garnish?

Okay so i got a car threw a auto place and i really shouldn’t of because i was young and stupid. but i had to make payments of 193 every two weeks. i was doing good for about a year then i lost my job. i was behind about two – three months. I went to go join the army. i drove my car to san diego because y dad was going to catch up my payments then watch the car when i was gone. so i joined the service and i wasn’t making payments because i didn’t get paid for two months and my dad refused to make more payments on the car for me. so i called the company and told them that i could paid them 1000 dollars when i get paid i finally got paid and i did pay them 1000 dollars i was still behind 600 dollars and i told them that i would get paid again in 2 weeks. the said that we really need the money i told them that’s all i could do they went ahead and repossessed the car. after i paid them 1000 dollars. and i was in active duty what can i do because they are mailing me and calling me saying i still owe them almost 10,000 dollars and there saying there going to take my taxes and garnish my wages. i need advice i need help. i never been in this situation before. i can’t afford to take those cuts. can i dispute it?

If they repossessed someone car and then there is some amount owed, is this legal for them to garnish someones wages who is on SSI and does not work , and who lives in California

I'm considering bankruptcy, but my father co-signed with me on an auto loan. Now the collection agency has filed to have my wages garnished. What will happen to my father if I file bankruptcy? Will they garnish his wages?
