After an argument, my brother-in-law gave the car back to my mother-in-law. She could not afford the payment and so my husband and I drove and made payments on it for 2 years before we had to purchase a new car. Since we were unable to make anymore payments, my mother-in-law decided to turn over the car to the bank. She called the bank and told them to come get it and dropped the insurance. It has been sitting in my driveway for 4 months. She gave them my address, so they know where it is. When will they come get it? Has there ever been a case where a bank didn&#8217;t repossess the car? What should I do? I don&#8217;t want it in my driveway anymore and my mother-in-law has nowhere to put it.<br />
Selling it isn&#8217;t really an option. Even if she would, she could only get half of the loan value. The car is only worth 4,000. So, she still owes a balance that she cannot pay.</p>

The driver in front of me hit the car in front of him and then I came over the hill and hit the guy in front of me.  My insurance company wouldn&#8217;t pay anything.  They said since I was in the back that I should have stopped.  Basically they said it my fault.  </p>
<p>Anyway, the car was totalled and I could not afford to pay for something that I couldn&#8217;t drive.  I told that to Capital One Auto (who I got the loan through) and they said that they would send someone to look at the car to see if it was worth repossessing.  They did that and said it wasn&#8217;t worth it, but that I still needed to pay them for the rest of the loan.  I told them that I couldn&#8217;t.  It is now August of 2011 and nothing has happened.  The car was charged off on my credit and from time to time I get letters in the mail from a collection agency saying that I need to pay.  I owed over ,000 when the accident happened and the last offer to settle from the collection agency was for ,900.  I would pay it if I could, but I don&#8217;t have even that kind of money.</p>
<p>This is getting long and I just wanted to know, if my wages were going to be garnished, would it have happened by now.  It has almost been a year and a half.</p>

			<content:encoded><![CDATA[<p>My partner sent off his Mazda rx8 for repairs a year ago, the people collected it from where it was (due to it not being able to be driven) &#8211; we heard nothing from the people and they ignored constant calls &#8211; we contacted police etc and they registered it stolen and &#8216;sorn&#8217; .  We later got a letter from the DVLA claiming that some one was trying to claim ownership of the car etc.  Police tracked it down to where the car was, with help of the DVLA and collected the car.  All was well and good until a few weeks ago when we found out the gentleman who had purchased the car (from an auction house) is now wishing to take the car to court to battle the fact that he is the true owner of the car.  He has no paperwork, no log book nothing!! We are now being told that if he win&#8217;s we have to pay £500 court fee&#8217;s and if my partner wins he will have to pay for the car to be released from the Police up North!!</p>
<p>Could any please shine a light on this situation with any advice that they know of&#8230;I know for a fact that the gentleman can&#8217;t claim ownership due to having none of the paper worn and it was his mistake for not checking the car history online (or through the DVLA) before purchasing.  He has paid for the car to be fully repaired but end of the day that is his own fault and not our problem?</p>

To those who have replied &#8211; I&#8217;m unsure of how to reply back to your comments or directly to you but thank you for your input &#8211; its much appreciated, at present I am fuming as I know its wrong.  I did accept the fact that if or when he wins the car back we would have to pay for it to be released and collected (which in my opinion is wrong as the police shouldn&#8217;t make the owner pay) but we expected that <img src='http://www.seizedcarauctionsinus.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /><br />
Again; still haven&#8217;t worked out how to reply to people individually &#8211; in answer to those about insurance etc; nothing has been paid out to my partner from insurance &#8211; he hasn&#8217;t had anything through.  All we have been told (as of today 5th Aug) is that we have 14 days to reply back to a letter saying that my partner is the true owner of the car&#8230;if the other person involved replies too saying he is owner than it goes to court for two hearings&#8230;one being a 5 min hearing and the other being more in depth&#8230;it states on the bottom of the letter that the looser pays £500 court fees and the winner of the hearing pays the storage charges of the vehicle (which i find wrong although it is my partners car &#8211; as it should never have been put in storage once rcollected from the person who bought the car)</p>
