Hi. I co-signed on a car for my cousin in 2008. The car got repossessed in 2009 and the balance shown as ‘charged off’ on my credit is K. Today they told me if I pay 1/2 the balance they can settle the debt and if not they will send me to judgment. If I don’t pay the ,500 today (don’t have that kind of money) the only option I have to avoid judgment is arrange monthly payment on the entire balance. My question is, will they work with me and lower this at all? Does Wells Fargo typically send people to judgment over this kind of balance (mostly fees) or do they sell it to a collection agency?

I havent made a payment since July 2009. The "bank" has gone to court and been issued a Writ of Possession. They havent shown up to my house yet. I hear that they’ll come with the police and repo guy. I plan to hide out in the house and not answer my door. The longer I string them along/stall for time, the longer I go judgement free. I figure if they get the vehicle back sooner, they’ll sue me that much sooner and start garnishing my wages. Seems to be to my advantage to string this out as long as possible. What happens if they never recover the vehicle? (its in Mexico)
Why would I surrender the vehicle? so they can auction it off for pennies on the dollar, then sue me for the balance? ohhhhhh, and garnish my wages. forget that, I’ll part this sucker out and give it back on blocks, lol
"Also, if the creditor doesn’t receive the vehicle back after going through the court ordered Replevin, then the creditor might include the term ‘P&L write off’ or ‘Subscriber cannot find’ in with their regular negative reporting of the account on your credit reports, which is far worse than just having a repo or a repo and a judgment on your reports." I plan to go chapter 7 BK and wipe everything out
Is it possible to beat the repo man? I’d have to say yes. I’ve beat the repo man like a "yard dog" for the last 2 years, lol. Even if they sue me and get a judgment for the full balance of the loan, plus repo charges, they’ll never recover the vehicle and I’ll declare chapter 7 bankruptcy and wipe out their judgment. I think its funny as hell to see "The Bank" continue to switch repo companies. They’ve burned through 3 different companies in the last 2 years. I think its funny to confuse their "skip tracing" software, by registering my credit cards to a relatives house 2,000 miles away. Also, turing on utilities for a buddy who is attending college out of state confuses them as well. The more time they waste with me, is one more day someone else more deserving gets to keep their car, because the repo guy is spinning his wheels with me. I cant wait until he shows up with the cops. I will come out, get really really really mad, tell them the vehicle "ain’t here" so "get lost." I will also trespass the repo guy in the presence of the officer, and is he returns, it will be considered "disturbing the peace" which is a big No No in the repo world. The cops can only arrest me if the vehicle is here
"Louis and Matt?????" are you serious? Those are actors. google them. You think that show is real? wow.

I have gotten behind on my car payment. I still owe part of the payment that was due on June 20 and the payment for July. They have already threatened to repo my car, which I accept because I know I have defaulted on the loan. Today, someone calls me and says they are going to enter a judgment on me tomorrow for the balance of the loan (00) if I can’t make a payment now. Can this actually happen, and if it can, why haven’t they been to get the car yet? Does that mean they will still repo the car if they are demanding that I pay the full remaining amount that I owe? Thanks.

I didn’t pay the difference. bc no1. you already took the car. so now i have no transportation. no2. you already ruined my credit by putting repossession on there so now the chances of me ever being again to get another car are virtually impossible. and now bc you sold the car less than what it’s actually worth, you expect me to make up the difference? why would i pay for a car i no longer have? if i couldn’t afford the payment when i had the car, what is the incentive of trying to make a payment on a car i no longer have? so they decided they were going to teach me a lesson and take me to court. so now on top of the repossession, i have a JUDGMENT. well, i signed up with truecredit.com and was able to view all 2 credit reports & credit scores. I disputed all 3 judgments and they were all removed. QUESTIONS: if they notice, can they put it back on? What are the chances of them noticing? MOST IMPORTANTLY!!!!!!!!!! , if i never pay, can they garnish my wages or take my tax refund? Please don’t GUESS. please really know what you are talking about! Typically with repossession judgments, how far can they go to get the money?
NOT THAT I SHOULD BE EXPLAINING THIS TO ANY OF YOU BUT I LOST MY JOB AND MY PAYMENTS FOR ALMOST 0 ON A FORD FOCUS BC IT WAS THE FIRST TIME I EVER FINANCED A VEHICLE AND SO I HAD A HIGH INTEREST RATE. SO THAT’S WHY IT WAS REPOED. I COULD AFFORD THE PAYMENT AT THE TIME I SIGNED THE DOTTED LINE.
"Moving on, yes, you are legally obligated to pay the balance left on the loan". YOU ARE ANSWERING THIS QUESTION AS IF I ASKED IT.

I THINK EVERYONE IS MISSING THE POINT OF THE QUESTION. I’m not asking if you think it’s politically correct for me to pay the money back. I’ve already made up my mind about that. I know i’m responsible for the difference. I want to know about the tax refund and the garnishment of the wages. I understand the logistics behind everything. i know that this is protocol for them. I understand all that. none of that matters to me. i just want to make sure my tax refund and my wages are protected from this foolishness.
they already places a judgment against me but it wasn’t to garnish wages. or else it would have been said in court right?

i know that there are 3 credit reporting agencies. that was a typo. if you notice after that, i said i said i disputed all 3 judgments!
equifax, experian and transunion, yes, i know this. this is one of the 1st things you learn about credit.
src50, they already placed a judgment , didn’t you read what i typed? we are past that. how long after the judgment will they garnish my wages bc its been over a year.

ALL YOU HAVE TO DO IS DISPUTE and the credit agencies will send out a letter asking the company to verify the account if they don’t respond in 30 days , legally it has to be removed.

WILL I BE WARNED BEFORE THEY GARNISH AND TAKE MY TAXES SO THAT I CAN HAVE TIME TO INTERVENE?
