Is Repo Still Possible?

21st July 2010

My auto loan has mature with Capitasl One. The problem is I have late fees that have accumulated from late payments in the past. Can I still get my vehicle repossessed for those late fee if I refuse to pay?? I’ve been trying to pay but the amount upfront is too much for and I only give partial payment which incurs more fees and the cycle goes on. Two things make their position unfair: 1. These are fees from the beginning of the loan which they said I did not have to be paid because they were not assessed as incurred and not retroactive (I have a letter to that effect). 2. I can’t get a hold of a live person. I’m automatically transferred to "recovery" services and instructed to leave a message which is never returned, as if they want to keep me there…..ponying up partial payments and adding more fees.

My mom co-signed for a car we purchased. I defaulted on the payment. I switched jobs and I had to change my bill due date and that’s when it all started. I had to pay late fees, and it just escalated. The bank ended up taking the car. I was reading on a few articles about car repossessions and I learned so much like tow fees, storage fees, and defiency loan I have to pay back. My mom still doesn’t know the car is gone, I am so scared to tell her. I am for sure that I owe money on the car when they sold it to the auction. I would just pay the difference but do you know if they accept payment arrangements? I am thinking of filing for bankruptcy, how will this affect the car loan and what happens to my moms credit? Will the bank put a lien on her properties? Please advise. Thank you.

In one month (September) i paid over ,200 because i was a little behind. So the balance left was like 0. I sent that payment in. On the next month i was hit with over dollars in late fees and with 0 past due plus 0 current. How did it go from 0 to over 00? I messed up by not disputing right away. I called and they said i was fine on my payments and i figured its just an error. And more recently in March i had 0 taken outta my bank account. I looked at my statement and it didnt even show that payment went through. And one week ago my car was repossessed. I try contacting them but they either hang up or just give me a new number to dial. And they say i cant speak to them in person. Am i screwed or is there something i can do?

I paid off my car loan in a few weeks ago – today I got the title in the mail . When I called to check my balance to be sure, they said I still owe 0 in late fees. They said if I don’t pay it by a certain date it would be charged off – is this true? Doesn’t that mean they would put it to a collection agency? Can they repossess the car if they sent me the title and agree that the actual car loan is paid off?

When I found out about this I immediately paid off the loan in full. The auto was not repossessed. Will this appear as a repo on my credit report or will I just get the two lates appearing?
"What finance company did you go through? B/C they should have not sent out an order for Repo. just becuase you’re two months late!"

I know, that’s what I thought. I phoned them and they said they can repossess 7 days after the first late. What annoys me is that I phoned then one day before the first late to say that I was raising the money to pay off in full and could they wait a while. They said yes and that they would even waive any late fees. Bunch of idiots.
