My mom had 45 years of GREAT credit then…
My mom is the co-signer of my sister’s car.
It got repossessed and we got the car back.
My sister makes late payments.

I want to get a car now, and the only way is to get a loan.
Is her credit report going to be too bad to get the loan?

I bought a car and made payments on it for two years before I sold it last year to a friend. He took over my car payments but the loan is still in my name. Since he’s had the car he has never made his payments on-time and sometimes I even had to pay a car note. I have to constantly remind him of the due date of the car payment like he is a child. He still won’t make the payment on the correct date. He just recently made up for two payments that I previously paid for him. To date he is a whole month late on his July car note and I have not recieved his August payment yet. Am I able to repossess the car back and just keep it for myself so that my credit will not be destroyed by his late payments? I know that I have always made regular payments when the car was with me and I don’t want the bank to come and repossess it and have that on my credit.
If I get the car back, will I be taking it illegally since he has made payments on it? And will he be able to take me to court for it?
Also, would I have to pay him back any payments that he made after I repossess it?

I was a couple months late on my auto loan. Repo man was sent out to retrieve my car. In between the repo man finding my car and towing it away I had sent a Western Union payment to cover the late payments (totalling 07). Repo man still took the car away. Bank has confirmation that money was sent and received. Can I still retrieve my car pay even after I’ve caught up on all my payments or does the bank have the right to keep the car?
Talked to lender earlier in the day and they said as long as I was about to pay the past due amount of 07 I would be able to keep the car. As I am sitting in the car to give them the confirmation number, repo man hooks my car up to his truck and says that once my car is hooked I cannot take it back. So not only am I caught up on payments, I will probably have to pay for the repo fee and storage and towing and whatever it is that cost to repo a car.

My car was repossessed January 3, 2009.

I received a letter from Wachovia stating their intent to sell my vehicle. I currently owe ,000 to them. I was considering letting the car go to auction but I know that even if I let the car go I will still owe whatever they don’t get at auction. My question for you is if I let my car go to auction, is there a way that I would be able to negotiate what is remaining? Also, what happens if I don’t pay what is remaining? The car is worth approximately ,000, by KBB standards. I am 2 1/2 months late on the payments but I’ve been late before on previous payments. The interest rate on the car is 15% and they have repeatedly denied refinance requests even after explaining extreme financial hardship to them (I’m a full time student and have been all year thus the debacle).

My credit isn’t great but I don’t have other debts. A few late payments throughout the years but the most damage that has been done has been done by the car & missing payments.

I’m at my wit’s end here, trying to figure out what to do. I may be able to get a used car from a friend and that is a blessing but I’m not sure what to do. Do you have any recommendations or suggestions on what would be best for the situation?

I really appreciate your help

Is Repo Still Possible?

21st July 2010

My auto loan has mature with Capitasl One. The problem is I have late fees that have accumulated from late payments in the past. Can I still get my vehicle repossessed for those late fee if I refuse to pay?? I’ve been trying to pay but the amount upfront is too much for and I only give partial payment which incurs more fees and the cycle goes on. Two things make their position unfair: 1. These are fees from the beginning of the loan which they said I did not have to be paid because they were not assessed as incurred and not retroactive (I have a letter to that effect). 2. I can’t get a hold of a live person. I’m automatically transferred to "recovery" services and instructed to leave a message which is never returned, as if they want to keep me there…..ponying up partial payments and adding more fees.
