I have a VERY complex situation. My car was repo’d, then approximately 24 hours after this I made the full payment. After 3 days my lien holder (Fifth Third Bank) released the vehicle and faxed the release to the repo company(ASR Nationwide) and transporters (Progressive Asset Recovery) of my vehicle.
The transporters then called me to let me know that the vehicle was moved to an auto auction(Manheim Auto Auction) and it would take a day for them to bring my car back. I found this wrong since I made the payment within 24 hours of it being repo’d. They took the trip to pick up my vehicle from the auto auction and called me later saying that the auto auction refused to give me my vehicle because THURSDAY was their "sale date" and the transporting company would need to come back on friday.
Friday they drove down to pick up my car and this time the excuse was that they don’t release vehicles on Friday – even though they told the transporters they could the day before. My lien holder, the repo company, and the transporters are sending emails and calling like crazy to get my car back. I just recently sent and called a few general managers and customer relation people myself, but….HAS ANY ONE HAD THIS EXPERIENCE??? ALSO, DOES ANYONE KNOW A LAW FIRM OR LAWYER IN MICHIGAN THAT COULD HELP?? I NEED TO KNOW WOULD I HAVE ANY OBLIGATION IF SOMETHING HAPPENED TO THE VEHICLE.

ok what happend was i bought my vehicle in 2007 and it was under my name but a year later it got stolen.. i had full coverage insurance which was under my parents name and i wasnt on the insurance. so the car was covered if my parents were the ones driving it and i wouldnt be if i was driving it.. so now it got stolen and i was the last person to drive it.. insurance doesnt want to pay.. the police found the car and took it to the impound.. i didnt have money to take the car out and they said it was totaled and i couldnt afford the damages..i contacted the lien holder they couldnt do anything.. i couldnt pay for it there was nothing i could of done….so i disputed with the insurance company but they would not cover me.. and now my credit has a repo on it.. my car was sold at the auction by the lien holder.. so what can i do or can i even do anything to take the repo off and fix my credit.. before the repo i actually had very good well average credit .. thanks for reading i know its a lot but im trying to buy a house with my parents and my credits in the way.. .

have you ever heard of this? My son was caught driving my car with no license so it was impounded for a mandatory 30 days. 20 or so days in while my car was sitting at their yard I get a lien notice. Well I was out of town for a week so it sat in my mailbox all that time. When I opened it it said if I intend to get my car out on the 30th day than i need to sign and send back the Declaration of Opposition so they dont issue the lean. It had to be post marked on the 10th day. When I finally got my hands on it, it was the 10th day so I went to the dmv that day since they were the lien holder to see if they can make note that I intend to get my car out.They could do nothing about it and said to mail it in asap. So I did, that day. 30th day came and I paid 00 to get my car out. I asked the police office why they would send me a lien notice so early when I had a mandatory 30 day hold and the officer said they do it just to start the process because it can be timely. I guess some people get their cars towed and think its too much money to get out and say forget it. They have to put a lien on it in order to sell it at auction. Long story short. Today I got a letter saying that DMV is the lien holder because my letter was not post marked within the 10 day timeline. It also says i need to put a restraining order on the lien holder and serve them as soon as possible. Im confused…Whats after that? It seems illegal to issue a lien before my 30 days was up. There was nothing I could do to get it any earlier or I would have. Has this happened to anybody?? What did you do to correct it??
My car is paid off and I now have it in my possesion since I paid the inpound fees. When the police called and said my 15 year old was caught in it they asked if i allowed him. I told them no but they still impounded it and released my son to me. The lien letter was called a Decloration of opposition. The one I got today said it was invalid due to it not being post marked within 10 days. it also says "If you wish to inquire regarding the disposition of your vehicle you must provide the department with either a restraining order issued by a california or United states court, or request from a law enforcement agency. If a restraining order is furnished, it must be served upon the director of motor vehicles or the dept’s legal counsel in Sacramento and must be accompanied by a copy of the complaint or petition. The restraining order must specifically restrain the department of motor vehicles from transferring the vehicle"

I had a car accident in 8/2009. My auto insurance was willing to pay for repairs. I had the car taken to a body shop. My insurance wrote a two party check. Before repairs could get done to my car the lien holder repossessed the car. I was out of work injured, lost my car and DEPRESSED. I filed for bankruptcy 09/2009. 04/2010 my insurance company called me and asked why i never cashed the check issued. I said it(check) was still with the body shop. They put a stop payment on the check and rewrote the check to a different body shop. ( NO I DON’T HAVE THE CAR) . I knew this body shop that did the works ( SOLD cars, body work and auto repair etc) . I found a car I liked and the owner and I went to cash it and the check had a stop payment!?! I called my insurance company and they said NO there is NO stop payment on the check. I returned the check and filed to take them to court.06/2010 I got a call from the lien holder and they stated they were contacted by my insurance company and they stated they were entitled to the money.I said I don’t think so because I filed bankruptcy 09/2009 and It would be complete 09/2010. My insurance’s lawyer is trying to get me to do a two party check with the lien holder….. I DON’T BELIEVE I OWE THEM ANYTHING.

Say you live in a different state or the car location is unknown to the lien holder….
