I was in a car wreck in April of 2010. The accident was not my fault. The driver in front of me hit the car in front of him and then I came over the hill and hit the guy in front of me. My insurance company wouldn’t pay anything. They said since I was in the back that I should have stopped. Basically they said it my fault.

Anyway, the car was totalled and I could not afford to pay for something that I couldn’t drive. I told that to Capital One Auto (who I got the loan through) and they said that they would send someone to look at the car to see if it was worth repossessing. They did that and said it wasn’t worth it, but that I still needed to pay them for the rest of the loan. I told them that I couldn’t. It is now August of 2011 and nothing has happened. The car was charged off on my credit and from time to time I get letters in the mail from a collection agency saying that I need to pay. I owed over ,000 when the accident happened and the last offer to settle from the collection agency was for ,900. I would pay it if I could, but I don’t have even that kind of money.

This is getting long and I just wanted to know, if my wages were going to be garnished, would it have happened by now. It has almost been a year and a half.

Illegal auto repossession?

11 months ago I bought a car at a buy-here-pay-here place with 00 down and 0 monthly payments. Due to downturn in my business I got behind. I spoke to the man at the lot and explained to him that I should hear something today and would let him know when I could get caught up. he agreed to that.
yesterday he showed up at my office and said he was taking the car, in front of a coworker, and loudly said how far behind I was, even called me (and about 20 others who owe him) a deadbeat and said my word meant nothing. he did give me time to get my personals out of the vehicle. One of his complaints was that he saw me driving the vehicle, and it wouldn’t bother him so much if I’d left it parked at home (if I didn’t need to drive the car, I wouldn’t have ever bought it).
Anyway, he had given me no notice that he was going to repossess and what I’ve read of Missouri law I think he should have. He also gave private information to other people (first time I was late he entered my church and told the first person he saw that he was there to get his van from me because i don’t pay, and he spoke to one of my neighbors about it). He was belligerent and hateful, and had me so stressed out i almost had to go to the ER, didn’t sleep last night, etc.
Was the way he took the car illegal? Does anyone know what my options are at this ppoint? Please don’t simply say "pay the bill" because i don’t have the money to pay the car completely off at this point, tho that’s what he says I need to do. Also don’t have the money for a lawyer right now…By the way, he never gave me a copy of the agreement I signed last year, but I know it was for 12 months and he now says 11 and my "time is up."

Ok-my boyfriend co-signed a car loan for a friend and this friend defaulted on making payments. He volutarily surrendered the car and they auctioned it off. Now, a collection company is calling my boyfriend wanting the remainder amount that is left. Can they do that even after the car has been repossessed? They told him he has until Friday or their client would take further action. He can’t pay what they are saying he has to pay…he told them what he could pay a month but they won’t accept it. I want to help him with this…any information you can provide would be greatly appreciated…

My car was repossessed January 3, 2009.

I received a letter from Wachovia stating their intent to sell my vehicle. I currently owe ,000 to them. I was considering letting the car go to auction but I know that even if I let the car go I will still owe whatever they don’t get at auction. My question for you is if I let my car go to auction, is there a way that I would be able to negotiate what is remaining? Also, what happens if I don’t pay what is remaining? The car is worth approximately ,000, by KBB standards. I am 2 1/2 months late on the payments but I’ve been late before on previous payments. The interest rate on the car is 15% and they have repeatedly denied refinance requests even after explaining extreme financial hardship to them (I’m a full time student and have been all year thus the debacle).

My credit isn’t great but I don’t have other debts. A few late payments throughout the years but the most damage that has been done has been done by the car & missing payments.

I’m at my wit’s end here, trying to figure out what to do. I may be able to get a used car from a friend and that is a blessing but I’m not sure what to do. Do you have any recommendations or suggestions on what would be best for the situation?

I’m going over my credit report, and feel pretty overwhelmed. I lost my car (rather it was repossessed) after losing my job and getting on unemployment, which is so much less that I can barely afford food every month, so forget about a car payment. And, quite frankly, I just want to know what happens if I don’t pay off these debts? I don’t have a lot of debts, but for a 21 year old college student, I’m pretty much in front of the financial firing squad as we speak. 5K on the car, 2K student loans (which don’t need to be paid back until I graduate), 1.5K on a Capital One card. Those are my concerns.
So question: what if I just never pay? Is it possible to rebuild my credit without paying them back? Doesn’t it reset every 7 years or something?
