I fell two and a half months behind in my car payment (Please don’t judge, I am a single parent who doesn’t receive child support from my ex-husband. I had ovarian cancer earlier this year and lost my job due to taking too much time off while I was sick. I have always supported myself and my daughter, it has just been a very tough year). I made arrangements with my finance company and paid 50% of my outstanding balance via Western Union on Monday. Even with that, my car got repossessed tonight. I have found through internet research that my finance company is known for doing that.

My daughter’s backpack and a few other things are in the car. I don’t have the money to get the car back now and I was wondering what will happen to my possessions now?

  1. I would guess that your bank would have the car, and the possessions.
    They probably hired an independant "repo" company to do the work for them.
    Just be super nice, and stress you only want those objects back. The bank has no interest in a little backpack, etc.

    If that doesn’t work..call the local TV station to do a report on the BIG BAD MEAN bank close to Christmas time. You’ll have your stuff delivered in a limo the same afternoon.

  2. Unfortunately, they will keep it until you pay. You can try asking, as a favor, but they do not have to oblige your request.

  3. Honestly, the tow company (if they have the keys or break in) can take what they want because you will have no proof they are "stealing" from you. My best friends car had gone into repo last year and they took everything that was worth anything out of her car, she actually was able to go pick it up the next day but she was out all that money and stuff. I told her to call the police department but she was too angry to deal with that. I hope nothing is taken from your car.

  4. They are suppose to give them back. They cannot just keep them anymore than if you were evicted the landlord can just keep you stuff. They throw it out on the curb. Your stuff might be with the towing company or whomever has the car now. Call and find out what happened to your stuff. Tell them that you consulted a lawyer and they either need to return your personal effects or give you a listing of what was taken with a deduction from the balance for each item.
    Bottom-line: They can’t just keep anything that you have in your house during an eviction nor can they just keep anything you happen to have in your car when they repossess.
