when a car is repossessed how long does consumer have legally to reclaim their vehicle?
3rd May 2011
I was purchasing a car from an buy here pay here car lot. I fell on hard times and lost my job and became one month late on my January payment, i made a partical payment and only owed 115, then i was also late with this months payment,so i only owed 0. Well the car lot sent a repo man out yesterday to pick up the car. I was devastated, however, i went to talk with the car lot people to try to make an arrangement to redeem my vehicle, to find that they sold my vechicle yesterday at auction…my question is "Is that legall or is there a time period when cn redeem the vehicle?

Some states have a "right to cure" or whatever the phrase is where they must wait a certain number of days before selling your car. Since you leave no relevant info, I’ll let you google that info for your state of residence.
Let’s be honest here…you were two months in default of your loan agreement. You really have no other shots to fire here.

Of course it’s legal.
You borrowed money, you didn’t pay, They took back the asset that belonged to them.
Your time period was up when you failed to make that second payment.

Some states have to hold it for 7 days, others 14, in TN I believe it’s 21, but I checked with the state and they don’t even know. To pick up the vehicle, in most cases, you would have had to pay off the entire balance owed plus repo and storage fees. I’m sure your vehicle was held for whatever the limit was because you didn’t make a payment in over 30 days. You broke your agreement by not paying on your vehicle so it was repossessed and sold.

Legally – 0 days, 0 minutes, 0 seconds.
You breached the contract, so it is now void.
The owner of the vehicle (the lot) can now do whatever they want with it, including selling it, burning it, or anything in-between.

I wouldnt be surprised if it’s totally unlawful considering BHPH are nests of crooks.
Call about 10 lawyers who practice consumer law and ask for advice on the phone. I’ve found most very helpful. Have all your paper work handy.
